Terms and Conditions for Diabetes is Serious Art Competition
By entering the Art Competition to win a £100 Tesco giftcard and an invitation to see your art displayed in the Houses of Parliament (the “Art Competition”), you agree to be bound by these terms and conditions. Please read them carefully.
Promoter
11. The promoter of the Art Competition is The British Diabetic Association operating as Diabetes UK (English charity no. 215199 and Scottish charity no. SC039136) Wells Lawrence House, 126 Back Church Lane, London E1 1FH (“Diabetes UK”).
Entry requirements
12. Participants must be legally resident in the UK.
13. Participants under the age of 18 must have permission from a parent or guardian to enter.
14. Employees or contractors of Diabetes UK and their immediate families and members of households, and anyone else connected in any way with the Art Competition are not eligible to take part.
15. You must supply full details as required by the online entry form and must have a valid email address to participate.
16. Diabetes UK reserves the right to require any participant to prove that he or she meets the entry requirements in these Terms and Conditions and is eligible to participate in the Art Competition.
How to Enter
17. The Art Competition will open at 12.00 on 17 February 2022. The Art Competition will close at 23.59 on 20 March 2022. After this time no further entries to the Art Competition will be permitted.
18. Entry to the Art Competition is free. No purchase or donation to Diabetes UK is necessary to enter the Art Competition.
19. To enter the Art Competition you must submit artwork using the Art Competition entry form online. Diabetes UK accepts no responsibility for entries not received for whatever reason.
20. Entries submitted by any other means will not be accepted. Any illegible, incomplete or fraudulent entries will be rejected.
21. Submissions to the Art Competition must be your own work, do not enter copyrighted art. Copyright infringement will be breached by the person who submits the work and not by Diabetes UK.
Prize on Offer
22. There are three categories and three prizes on offer. The overall winner of each of each of each category will receive a £100 Tesco giftcard and an invitation to attend the Diabetes UK Art Exhibition in the Houses of Parliament on 20th April 2022. Standard class travel expenses will be reimbursed where original receipts can be provided. Overnight accommodation is not included. Under 18s must be accompanied by a parent or guardian. Prize winners over the age of 18 can chose to be accompanied by one other person.
23. The prize[s] are non-transferable. Diabetes UK reserves the right to substitute the prize for a prize of equivalent or greater value, or at Diabetes UK’s sole discretion, the cash value of the prize, if this is necessary for reasons beyond Diabetes UK’s reasonable control.
24. The prize includes costs to deliver the prize to an address in the UK.
How the winner will be chosen
25. The winners of the Art Competition will be chosen from all complete, eligible, properly submitted entries received before the closing date and time. Winners will be selected by an independent panel of people living with and affected by diabetes and Diabetes UK staff within 5 working days of the draw closing.
26. The winners will be notified within 10 working days of the draw using the email address provided on the entry form.
27. In the event that contact with a winner cannot be made within 15 working days of the draw date or the winner is found not to meet the entry requirements in these Terms and Conditions, Diabetes UK reserves the right to withdraw the prize entitlement and to award the prize to another participant who will be selected by the judging panel.
Publicity and Data Protection
28. By entering the Art Competition, participants agree to have their artwork, first name and constituency featured in any reasonable publicity relating to the Art Competition and in future marketing activities without further reference, payment or other compensation.
29. By entering the Art Competition, participants grant Diabetes UK permission to display their artwork, first name and constituency on our online gallery, report and/or at our Parliamentary art exhibition without further reference, payment or other compensation.
30. For one month from the closing date of the Art Competition, we will make available on request, information that indicates that a valid selection has taken place. Such a request can be made by sending a letter and stamped address envelope to Helen Kirrane, Diabetes UK, Wells Lawrence House, 126 Back Church Lane, London E1 1FH. Unless the winner has requested otherwise, this information will be the surname and county of the winner. Diabetes UK may also have to provide details of the winner of the Art Competition to the Advertising Standards Authority, in the event such information is requested.
31. Diabetes UK will collect and process participants’ personal information in order to conduct the Art Competition and this information will be shared with Diabetes UK’s agents to the extent necessary for the Art Competition to be administered and the prize to be delivered to the winner[s]. Participants’ names and other personal details from their entry to the Prize Draw will be collected and stored by Diabetes UK and will be held in accordance with the applicable privacy policy in place from time to time (see privacy policy here).
Liability
32. Diabetes UK reserves the right to amend these Terms and Conditions without notice, by posting changes to the following webage: https://forms.diabetes.org.uk/art-competition
33. Diabetes UK reserves the right to modify, cancel, terminate or suspend Art Competition in whole or in part, at its sole discretion, if it believes the Art Competition is not capable of being conducted as specified within these Terms and Conditions or in the event of any other cause that is beyond the reasonable control of Diabetes UK that could affect the normal course of the Art Competition.
34. Neither Diabetes UK nor any of its subsidiary or affiliated companies are responsible for any losses, failures or delays caused by events beyond its or their control such as (but not limited to) the acts or defaults of any supplier selected by Diabetes UK to provide the prize that may lead to loss or damage of the prize in transit to the winner.
35. Diabetes UK endeavour to take care of your work, but will not be liable for any loss or damage to any artworks physically submitted at any point, however caused, whether in transit to and from the exhibition, or during any period of storage, packing or unpacking, exhibition or in any period in which the work is in their or their agents keeping.
36. For any artworks submitted to the competition, you are not restricted in selling it, exhibiting it or any similar activity. But we ask you that you notify us if it is sold or changes ownership, or changes in any way. You may notify us if you wish to remove the artwork from consideration by the Judging Panel at any time.
37. Save where it has been negligent, Diabetes UK will not be responsible for any damage, loss or injury resulting from participants’ entry into the Art Competition or their acceptance and/or use of the prize, or for technical or difficulties of any kind that may limit or prohibit their ability to participate in the Art Competition. Nothing in these Terms and Conditions shall in any way limit Diabetes UK’s liability for death or personal injury caused by its negligence or any other matter where liability may not as a matter of law be limited.
38. Any participant who enters or attempts to enter the Art Competition in a manner, which in Diabetes UK‘s reasonable determination is contrary to these Terms and Conditions or by its nature is unjust to other entrants may be rejected from the Art Competition at Diabetes UK’s sole discretion. Furthermore, where such actions have significantly impaired the Art Competition, Diabetes UK may, at its sole discretion, add further stages to the Art Competition as it deems reasonably necessary in order to resolve any problems arising as a result of such actions.
39. Diabetes UK will promote artwork at its sole discretion. Artwork that violates any social media platform's terms and conditions of use (e.g. explicit images, offensive language, nudity, etc.) will not be included. We reserve the right to exclude Artwork for censoring purposes in order to not violate the terms and conditions of social media platforms that we are using.
40. All of Diabetes UK’s decisions in relation to the winner of the Art Competition are final and Diabetes UK will not enter into any correspondence with participants.
41. Entry to the Art Competition will be deemed to constitute acceptable of these terms and conditions.
42. These Terms and Conditions are governed by English Law. The courts of England and Wales shall have exclusive jurisdiction to hear any dispute or claim arising in association with the Art Competition or these Terms and Conditions.
